Terms of Use

Welcome to Lichfield Institute ("we," "our," or "us"). By accessing or using our website, located at [lichfieldinst.org] (the "Site"), and the services, features, or content offered through the Site (collectively, the "Services"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.  

 

1. Acceptance of Terms  

By accessing or using our Services, you agree to these Terms and any other policies or guidelines posted on the Site. We may update these Terms from time to time, and any changes will be effective when posted on the Site. It is your responsibility to review these Terms periodically for updates or changes.

 

2. Use of Services  

(a) Eligibility: You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are of legal age to form a binding contract with us.  

(b) Account Registration: Some features of our Services may require you to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

(c) Prohibited Conduct: You agree not to:  

Use our Services for any unlawful purpose or in violation of any applicable laws or regulations.

Post, upload, or transmit any content that is offensive, harmful, or violates the rights of others.

Use automated scripts to collect information from the Site without our permission.

Attempt to interfere with, disrupt, or harm our Services or servers.

 

3. Online Classes and Contests

(a) Online Classes: We may offer online classes on a variety of subjects. These classes may be free or subject to fees, as indicated on the Site. We reserve the right to modify or discontinue any class at any time without notice.  

(b) Independent Writing Contests: We may host independent writing contests with specific rules and guidelines. By participating in these contests, you agree to adhere to the contest rules and grant us the right to use your submitted content as specified in the contest terms.  

4. Your Work and Content

You are solely responsible for the writing you submit or any other information you provide, distribute, post, include, link to, or otherwise upload to the Lichfield Site ("Your Content"), and You agree that We are only acting as a passive conduit for online announcements regarding your content. You represent and warrant that your content shall: (a) be Your original work, (b) not infringe any copyright, patent, trademark, trade secret, or other proprietary right or right of publicity or privacy; (c) not violate any law or regulation; (d) not be defamatory or trade libelous; (e) not be obscene or contain child pornography; (f) not include incomplete, false or inaccurate information about yourself or any information about any other individual; and (g) shall not contain any viruses, trojan horses, worms, time bombs, cancel-bots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. We reserve the right (but not the obligation) to take any action with respect to your content if we believe that it may create liability for Us or may cause Us to lose the services of our ISPs or other suppliers. 

5. Privacy  

Our Privacy Policy page explains how we collect, use, and protect your personal information. By using our Services, you consent to the practices described in the Privacy Policy.  

6. Refund Policy

Lichfield Institute has no refund or exchange policy unless explicitly stated.   Intangible online services, such as writing contest entries, and digital products, such as ebooks and guides, are not refundable unless explicitly stated. If you experienced problems with our payment processor or did not receive your digital item, please email us a detailed description of the problem at: [study@lichfieldinst.org].

7. Confidentiality of Guest Judges and Lecturers

(a) Anonymity Commitment: In recognition of the sensitivity surrounding the professional reputation and personal privacy of our guest lecturers and judges, Lichfield Institute is committed to maintaining confidentiality regarding their identities. This is to ensure an unbiased, secure, and respectful environment for both our esteemed guests and participants.  

(b) Non-Disclosure: The identities of guest lecturers and guest judges will not be disclosed under any circumstances. This non-disclosure applies to all parties involved, including staff, participants, and third parties.  

(c)  Participant Acknowledgment: By participating in our writing contests or engaging with our online education platform, participants acknowledge and agree that the identities of guest lecturers and judges will remain anonymous. Participants are expected to respect this aspect of confidentiality as a condition of their participation.

8. Termination  

We may terminate or suspend your account and access to the Services at our discretion, without notice, for any reason, including a breach of these Terms.

 

9. Disclaimers

(a) No Warranty: Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

(b) Limitation of Liability: To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.  

10. Governing Law

These Terms are governed by and construed in accordance with the laws of California, without regard to its conflict of law principles.
